Please find enclosed details of your consumer credit licensing arrangement.
As a licensee it is important to remember that you have a duty to notify the Office of Fair Trading (‘OFT’) of certain changes in details affecting your business. All changes should be notified to the OFT in writing within 21 working days of the change taking place. Failure to do so is a criminal offence. The relevant changes are:
Any change in your main place of business, any change in your registered office address or correspondence address.
Any change in your company officers, any change in your controller(s) and, where relevant, changes to a controller’s officers.
Any of the changes referred to above should be notified to the OFT on the relevant notification of changes forms available on our website at www.oft.gov.uk .
A licence held by a company terminates if the company is dissolved or struck off the Companies House register.
Any officer of the company should inform us as soon as possible after the event. If the company is later resurrected it will have to apply for a new credit licence.
You will need to apply to vary your licence if you wish to make any of the changes listed below:
- a change of name of licence holder
- a change of trading name, either additions or deletions of old names,
- addition/deletion of a category of business activity
- addition/deletion of authorisation to canvass off trade premises.
You should apply to vary your licence on form CC15/05 available on our website at www.oft.gov.uk or you can contact us on 020 7211 8650 for an application form.
When you receive your varied licence it will show details of your original licence and the variation that has been made.
You should not consider yourself as licensed under any new name of category of business activity until you receive the varied licence.
A name may be refused if it is considered to be misleading or undesirable.
If you want to change your status for example from a sole trader to a partnership or a partnership to a limited company you will need to apply for a new licence. A licence cannot be varied to pass between one legal entity and another.
